WILLS AND TRUSTS
A last will and testament can be critical for the distribution of real and personal property upon your death. California wills give the person signing the will the opportunity to leave assets to a spouse, domestic partner, children, relatives, friends, charitable organizations, and others; even provisions for pet care may be included.
A trust is an arrangement under which one person, called a trustee, holds legal title to property for another person, called a beneficiary. You can be the trustee of your own living trust, keeping full control over all property held in trust. This can be used instead of or in addition to a will in an estate plan.

ESTATE PLANNING
Estate planning is the preparation of tasks that serve to manage an individual's asset base in the event of their incapacitation or death. The planning includes the bequest of assets to heirs and the settlement of estate taxes. Most estate plans are set up with the help of an experienced attorney.
Planning tasks include making a will, setting up trusts and/or making charitable donations to limit estate taxes, naming an executor and beneficiaries, and setting up funeral arrangements.

Tax planning takes on increased significance when federal and local governments begin announcing proposals to raise revenues in advance of enacting legislation aimed to increase taxes. WHITE HOUSE ADDS DETAILS TO ITS FAR-REACHING 2021 TAX REFORM PLANS

The White House today released The American Families Plan, which includes some new details regarding the Biden administration’s proposed 2021 tax reform. The tax changes expected to be enacted this year will be substantial and far reaching and will include corporate, individual and capital gains tax rate increases; international tax changes; and estate and gift tax changes.
A GUIDE TO POTENTIAL TAX LAW CHANGES UNDER BIDEN

Given other priorities and the realities of the legislative process, it seems unlikely that tax law changes would apply retroactively to the beginning of this year. Congress has, however, previously made even mid-year changes retroactively applicable, and it’s also possible that certain proposed changes could be enacted more quickly than others. Despite this uncertainty, we believe our clients should consider now how these proposed changes might affect them and whether they want to implement certain strategies sooner rather than later.
